Terms of Service

Welcome to ShikshaNXT. These Terms of Service ("Terms") govern your access to and use of the ShikshaNXT platform, services, and website. By accessing or using our services, you agree to be bound by these Terms.

1. Definitions

• "ShikshaNXT" refers to our school management platform, including all features, functionalities, and services offered.
• "Institution" refers to the educational organization that has subscribed to use the ShikshaNXT platform.
• "Users" refers to administrators, teachers, staff members, students, and parents who access the platform through accounts created by the Institution.
• "Subscription" refers to the paid service agreement that allows the Institution to access and use ShikshaNXT.
• "Content" refers to all data, information, and materials uploaded, created, or stored by the Institution and its Users on the platform.

2. Account Registration and Security

To use ShikshaNXT, Institutions must register for an account. The primary administrator from the Institution is responsible for:

• Providing accurate and complete information during the registration process
• Maintaining the confidentiality of account credentials
• Creating and managing User accounts based on appropriate roles and permissions
• Ensuring Users comply with these Terms and any Institution-specific policies
• Notifying ShikshaNXT immediately of any unauthorized access or security breaches

3. Subscription and Payments

ShikshaNXT offers subscription-based access to its platform:

• Subscription fees are based on the number of students enrolled in the Institution and selected feature set
• Payments are due as specified in the subscription agreement (monthly, quarterly, or annually)
• Subscription cancellations can only be processed at the end of the academic year/session, not in between, to ensure continuity of service
• Failure to make timely payments may result in limited access or suspension of services
• All fees are non-refundable unless otherwise specified in the subscription agreement

4. Institution Content and Data Ownership

The Institution retains ownership of all Content uploaded to or created on ShikshaNXT:

• ShikshaNXT does not claim ownership of your Content
• You grant ShikshaNXT a limited license to host, store, and process Content solely to provide and maintain the services
• You are responsible for ensuring all Content complies with applicable laws and regulations
• Upon termination, the Institution may request Content export in standard formats within the timeframe specified in our data retention policy

5. Acceptable Use

The Institution and its Users agree not to:

• Use the platform in any way that violates applicable laws or regulations
• Share account credentials or provide platform access to unauthorized individuals
• Upload or transmit malicious code, viruses, or harmful data
• Attempt to gain unauthorized access to any part of the platform or other accounts
• Use the platform to store or transmit infringing, defamatory, or otherwise unlawful content
• Interfere with the platform's operation or place undue burden on its infrastructure

6. Privacy and Data Protection

ShikshaNXT is committed to protecting the privacy and security of all data. Our Privacy Policy, which is incorporated into these Terms by reference, details how we collect, use, and safeguard your information. The Institution is responsible for obtaining appropriate consents for data collection and processing from its Users in compliance with applicable data protection laws.

7. Limitation of Liability

To the maximum extent permitted by law, ShikshaNXT shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, or business opportunities, resulting from your use of the platform or any content therein, regardless of the theory of liability.

8. Term and Termination

These Terms remain in effect for the duration of your Subscription:

• The Institution may terminate its Subscription as specified in the subscription agreement
• ShikshaNXT may terminate or suspend access in case of Terms violation or extended payment delinquency
• Upon termination, the Institution will have limited time to export Content before permanent deletion
• Provisions that by their nature should survive termination shall remain in effect

9. Modifications to Terms

ShikshaNXT reserves the right to modify these Terms at any time. We will provide notice of significant changes through the platform or by email to the primary administrator. Continued use of the platform after such modifications constitutes acceptance of the updated Terms.
